Frequently Asked Questions

Registration of a Will is not mandatory under Indian law — an unregistered Will is equally valid if properly executed (signed by testator + attested by two witnesses). However, registration provides strong evidence of authenticity, is harder to challenge, and can prevent disputes among heirs. It is always advisable to register your Will.
A Leave & License grants permission to occupy premises for a specified period without creating any interest in the property — the licensor retains full ownership rights. A Lease creates a legal interest in the property for the tenant. In Maharashtra, most residential and commercial rental arrangements use Leave & License agreements to give landlords more control and easier recovery of possession.
A General or Specific Power of Attorney can authorise a person to execute property transactions on your behalf. However, the Supreme Court has held that a GPA-based transfer does not by itself confer ownership — the underlying sale deed must be registered. An attorney holder can sign and register a sale deed on behalf of the principal if the POA specifically authorises this.
